It transposes EU Directive 2022\/2557 (the CER Directive) into German law and, for the first time, explicitly obliges operators of critical facilities to ensure <strong>physical resilience<\/strong> \u2013 alongside cybersecurity under NIS2. The sectors covered include information technology and telecommunications \u2013 but important exemptions apply to data centers (see below).<\/p>\n<h2>Key obligations at a glance<\/h2>\n<ul>\n<li><strong>Registration<\/strong> of critical facilities with the Federal Office of Civil Protection and Disaster Assistance (BBK).<\/li>\n<li><strong>Risk assessments<\/strong> based on the national risk assessment.<\/li>\n<li><strong>Resilience measures and a resilience plan<\/strong> \u2013 technical, organisational and security-related, including emergency preparedness, physical and personnel security and regular training.<\/li>\n<li><strong>Reporting obligations<\/strong> for significant incidents.<\/li>\n<li><strong>Management accountability<\/strong> for implementation \u2013 breaches can lead to substantial fines.<\/li>\n<\/ul>\n<p><strong>Important for data centers:<\/strong> Operators of critical facilities in the IT and telecommunications sector \u2013 which includes data centers \u2013 are exempt from key parts of these obligations under Sec. 4(2) no. 2 KRITISDachG, including risk assessment and resilience measures (Secs. 12 to 16). For them, the main framework is the BSI Act as amended for NIS2, plus the contractual requirements of operators and clients. In practice, physical and personnel security remain on the agenda \u2013 just on a different legal basis. As of October 2026; not legal advice.<\/p>\n<p>Deadlines are linked to registration. Which facilities are covered is determined by thresholds set by ordinance \u2013 every operator needs to assess its own situation.<\/p>\n<h2>Why it matters on the construction site<\/h2>\n<p>A data center does not become critical infrastructure only when it goes live. Controlling and documenting access, keys, materials and personnel during construction lays the groundwork operators will later need to evidence in their risk assessment and resilience plan. Gaps from the construction phase \u2013 unclear access rights, unvetted staff, missing records \u2013 are hard to close once the site is operational.<\/p>\n<h2>What this means when choosing a security provider<\/h2>\n<ul>\n<li><strong>Personnel security:<\/strong> vetted staff with police clearance, registered in the German security register, with NDAs \u2013 extended checks on request.<\/li>\n<li><strong>Fixed staff pool:<\/strong> named teams instead of rotating floaters.<\/li>\n<li><strong>Documented access control:<\/strong> badges, visitors, keys, tool and material checks \u2013 recorded audit-proof.<\/li>\n<li><strong>Training records:<\/strong> inductions, fire safety assistant, first aid, de-escalation \u2013 evidenced.<\/li>\n<li><strong>Incident management:<\/strong> clear reporting and escalation paths with complete reports.<\/li>\n<li><strong>Seamless transition<\/strong> from construction to live operations without changing provider.<\/li>\n<\/ul>\n<h2>How Solid Safety supports you<\/h2>\n<p>Solid Safety specialises in data centers and has supported 48 data center projects \u2013 with experience at KRITIS facilities.
